Fairfax man faces 23 criminal sex counts
GAYLORD – A 37-year-old Fairfax man faces 23 counts of criminal-sexual conduct in Nicollet County.
Troy M. Berger, 309 1st Street S.E., Fairfax, faces eight first-degree counts and 15 second-degree counts in Nicollet County plus three second-degree counts in Sibley County. The alleged female victims were all under age 14 and knew each other, according to the Nicollet County Sheriff’s Office.
Berger’s bail was set at $100,000, $10,000 bond, at his first appearance in Sibley County Court Thursday. His initial Nicollet County Court appearance has not yet been set.
An omnibus hearing was set for 11 a.m. Thursday, March 7, 2013 in Sibley County District Court.
Berger lived in Sibley County, most of the time in the Arlington, Winthrop and Gibbon areas plus Bernadotte Township, for about a year before moving to Fairfax, according to Nicollet County authorities.
Offenses took place between April 2011 and September 2012, according to the complaint.
In an interview with a Renville County Sheriff’s Investigator, Berger initially denied touching the alleged victims inappropriately, then admitted to doing so while living in Bernadotte Township, once or twice a week over several years. Berger estimated he committed a sexual assault about 30 times a year, according to court documents.
A Renville County Sheriff’s Investigator obtained a statement from Berger’s wife Shelly who confirmed the family lived in a Bernadotte residence from April 11, 2011 until September 2012, according to the complaint. She faces a gross misdemeanor charge in Sibley County, in connection with the case, according to Nicollet County authorities.
