Fairfax man sentenced on 3 felony sex counts
GAYLORD – A 37-year-old Fairfax man convicted of three felony second degree criminal sexual conduct charges in Sibley County District Court was sentenced to more than nine years in prison on June 6 in Sibley County District Court.
Troy M. Berger – who originally faced 26 counts of criminal sexual conduct with female victims all under age 14 in Sibley, Nicollet and Renville counties – was sentenced to 110 1/3 months at the St. Cloud Correctional Facility and 55 1/3 months supervised release, according to court documents. He was credited with 127 days served in jail.
The victims knew each other, according to court documents.
Berger formerly lived in Winthrop, rural Gibbon, Arlington and Bernadotte Township before moving to Fairfax, according to Nicollet County authorities.
Offenses took place from April 2011 to September 2012, according to the complaint.
Berger admitted to committing sexual assault about 30 times a year, according to an interview with a Renville County Sheriff’s Investigator.
His wife Shelly K. Berger, 37, Gibbon, was sentenced to a year in the Nicollet County Jail on June 4, 335 days were stayed for two years supervised probation for one count of gross misdemeanor child endangerment-situation could cause harm or death. She was fined $980, and she was ordered to pay restitution to be determined and to have a complete mental health evaluation in Renville County and pay fee. Shelly Berger is scheduled to be sentenced for one count of gross misdemeanor child endangerment at 9:30 a.m., Friday, June 21 in Sibley County District Court.
